Video evidence, common in football but questionable in bullying and neighborhood disputes

Anyone who falls victim to bullying would like to gather evidence to take legal action against the perpetrator. Bullying is unfortunately common in the workplace, but can also occur at home by neighbors. Would like to create evidence with which the bullying can be clearly proven. It is often recommended to keep a bullying diary in which the individual events are documented as precisely as possible with time and place. However, if only the diary is kept, this is of course always a subjective account, which can easily be denied by the mobber.

Today, modern electronics offer a variety of ways to obtain evidence. Video recordings, for example, can provide excellent evidence and can be easily captured today with video recorders or with surveillance cameras. However, the use of such means to obtain evidence is often dubious and not accepted in court.

Two different situations should be distinguished. One case is bullying suffered in one's own home, for example, by a neighbor. In such cases, one can use a video camera in most cases legally harmless to film a situation. However, in public places or even in the workplace, the situation is much more complicated. There, the bullies are also legally protected and may not be filmed without their consent. In court, you can therefore often create problems for yourself as a mobbing victim, because you have also broken the law by making unauthorized recordings. In general, it is therefore recommended to consult a lawyer and find out how to compile video evidence that will carry weight in court and be recognized as evidence.
