  • Video and film recordings are not always allowed in neighbour disputes

Disputes with neighbours can escalate very quickly. Often people act impulsively and rather rashly. However, this can get you into even more trouble, and such disputes between neighbours are even ending up in court more and more often. Especially when cameras come into play or crimes are even feigned, you are quickly the defendant, and rightly so. After all, there are laws that everyone must abide by, even in the event of a dispute. So what exactly is allowed and what is not?

Filming your own property is allowed

In neighbour disputes, people are quickly inclined to record everything on video. After all, one assumes that this is the way to secure evidence. But filming and taking photos are not always allowed and can infringe the neighbour's rights. The neighbour can defend himself against this by seeking an injunction from a lawyer, but also in court. In the end, you are the one who is in big trouble and the dispute with your neighbour can escalate. However, filming, for example by surveillance cameras or wildlife cameras, is permitted in certain cases. Provided that only one's own property is filmed. However, public roads must not be in the camera's field of vision and driveways shared with neighbours must not be filmed. If, for example, you suspect that your neighbour is graffitiing your front door, stealing mail or throwing things such as rubbish into your garden, then this may be recorded on camera, provided that only your own property is filmed. Such recordings can often be used as evidence in court, for example, if the neighbour is charged with damage to property.

In such cases, filming is permitted even without consent, as long as it is not published. This is because the right to privacy and the right to one's own image then apply, which the neighbour can then take action against. So this should always be taken into account: Never post such recordings on the internet, not even out of the situation in order to finally show it to the hated neighbour!
